Introduction
Real Knowledge Academy (“RKA”, “we”, “our”) is an educational tutoring business operating under an Australian Business Number (ABN) in Queensland, Australia.
These Terms & Conditions govern:
• Use of the Real Knowledge Academy website
• Engagement of tutoring or mentoring services
• Participation in structured programs, including Project 99.95 Elite
• Access to educational materials
By accessing our website or engaging our services, you agree to these Terms.
Where a student is under 18 years of age, a parent or legal guardian must accept these Terms on the student’s behalf.
Services
RKA provides academic tutoring, mentoring, and structured academic performance programs for secondary students.
Services may include:
• One-on-one tutoring
• Group sessions
• Online sessions
• Academic mentoring
• Structured performance programs
• Access to proprietary educational materials
Delivery methods may vary and may be conducted in-person or online.
We reserve the right to modify service formats where reasonably necessary.
Academic Outcomes
RKA provides educational support services.
We do not guarantee specific grades, ATAR scores, university admission outcomes, scholarships, or examination results. Academic performance depends on individual student effort, engagement, attendance, and external assessment processes beyond our control. Nothing in these Terms limits rights under the Competition and Consumer Act 2010 (Cth), including Australian Consumer Law.
Fees and Payment
Fees are communicated prior to commencement of services. Unless otherwise agreed:
• Fees are payable in advance or as invoiced
• Subscription programs operate on a recurring monthly basis
• Services may be suspended for non-payment
All fees are in Australian Dollars (AUD). GST will apply where required under Australian law.
RKA may vary pricing with reasonable notice.
Cancellations and Rescheduling
Reasonable notice is required to reschedule sessions.
Where insufficient notice is provided, the session may be forfeited and fees may still apply.
RKA may reschedule sessions due to illness, emergency, or operational requirements, providing reasonable notice where possible.
Refunds
Refunds are provided in accordance with the relevant program terms and Australian Consumer Law. Change-of-mind refunds are not guaranteed unless expressly stated.
Nothing in these Terms excludes statutory rights under Australian Consumer Law.
Minors and Parental Responsibility
For students under 18 years of age:
• A parent or legal guardian must authorise enrolment
• The parent or guardian accepts financial responsibility
• The parent acknowledges the nature and scope of services provided
Online Delivery and Recordings
Where services are delivered online:
• Approved third-party platforms may be used
• Reasonable steps are taken to ensure appropriate security
• Sessions may be recorded for quality assurance, safeguarding, or student access
Recordings remain the property of Real Knowledge Academy.
Child Safety and Safeguarding
Real Knowledge Academy is committed to providing a safe, supportive, and respectful learning environment for all students. RKA operates in accordance with the Child Protection Act 1999 (Qld), the Working with Children (Risk Management and Screening) Act 2000 (Qld), relevant Queensland child safety standards, and the Privacy Act 1988 (Cth).
Blue Card Compliance
Where required by law, tutors and staff providing services to students under 18 years of age hold a current valid Queensland Blue Card or are lawfully exempt under Queensland legislation. RKA maintains appropriate records of Blue Card status.
Safeguarding Measures
RKA implements reasonable risk management practices, including maintaining professional boundaries, conducting sessions in transparent settings (physical or online), and using approved communication platforms. Online sessions may be recorded for safeguarding and quality assurance purposes. Parents may request clarification regarding recording practices.
Professional Boundaries
Tutors must maintain clear professional boundaries, avoid inappropriate relationships or private communication outside approved channels, and ensure parental awareness when engaging with students under 18.
Intellectual Property
All materials provided by RKA, including teaching resources, frameworks, recordings, branding, and written content, remain the intellectual property of Real Knowledge Academy.
Materials may not be copied, reproduced, shared, distributed, uploaded, or resold without prior written consent. Unauthorised use may result in termination of services and legal action.
Student Conduct
Students must behave respectfully and engage appropriately during sessions.
RKA reserves the right to suspend or terminate services where conduct is inappropriate, disruptive, or unsafe.
Limitation of Liability
To the extent permitted by law, RKA is not liable for indirect, incidental, or consequential loss arising from the use of its services or website.
Where services are supplied, RKA’s liability for failure to comply with statutory guarantees under Australian Consumer Law is limited, at RKA’s option, to:
• Re-supplying the services; or
• Paying the cost of having the services supplied again.
Nothing in these Terms excludes rights that cannot lawfully be excluded under Australian law.
Website Use
Users must not:
• Use the website unlawfully
• Attempt to interfere with website functionality
• Misuse booking or contact systems
RKA may restrict access where misuse occurs.
Privacy
RKA collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

Dispute Resolution and Governing Law
These Terms are governed by the laws of Queensland, Australia.
The parties submit to the exclusive jurisdiction of the courts of Queensland.
In the event of a dispute, the parties agree to first attempt resolution through good faith negotiation.
Amendments
RKA may update these Terms from time to time.
Continued use of the website or services constitutes acceptance of any revised Terms.
