1) The Real Knowledge Academy provides academic tutoring services, mentoring, and
structured academic performance programs for students. The Real Knowledge Academy
(“RKA”, “we”, “our”) is an educational tutoring business (ABN: 92 696 028 648) based in
Queensland, Australia.
2) Specific terms and conditions govern the use of the Real Knowledge Academy website,
access to any educational materials, engagement of Real Knowledge Academy tutoring,
coaching services and mentoring services, as well as any participation in any structured
program, including Project 99.95 and Project 99.95 Elite.
3) The Real Knowledge Academy terms and conditions (“terms and condition”) apply to all
Real Knowledge Academy services, content and interactions with RKA, including but not
limited to our website, social media platforms such as Instagram and Facebook, podcasts,
online programs and any other digital or physical offerings provided.
4) Real Knowledge Academy services may include but are not limited to one-on-one tutoring
sessions, group sessions, online sessions, academic mentoring, coaching, structured
performance programs and access to proprietary educational materials.
5) Service delivery methods may vary and may be conducted in-person, online, through the
provision of educational materials or other means.
6) By accessing the RKA website or engaging RKA services, you agree to our terms and
conditions.
7) Where a student is under 18 years of age, a parent or legal guardian must accept these
terms and conditions on behalf of the student and accept the nature and scope of the
services provided. A parent or legal guardian must authorise enrolment of the student and
accept financial responsibility to cover any costs and fees associated with RKA services and
programs.
8) All RKA fees are in Australian Dollars (AUD). GST will apply where required under
Australian law.
9) Applicable fees for RKA services are advertised on the website. Fees are payable prior to
commencement of services. Subscription programs operate on a recurring monthly basis for
which invoices are issued and payable in advance on a monthly basis. Non-payment of fees
may result in suspension or termination of services, programs and website access. RKA
reserves the right to vary pricing of services and programs from time to time.
10) Students must at all times behave respectfully and engage appropriately during sessions
or programs. In the event that a student breaches expected standards of behaviour, the
student’s parent/guardian will be notified. Multiple breaches may result in suspension of a
student or termination of educational services.
11) RKA reserves the right to suspend or terminate the provision of educational services to a
student where the student’s conduct is deemed to be inappropriate, disruptive, or unsafe.

12) A student or parent/guardian may request to reschedule a scheduled session by
providing at least 24 hours’ notice prior to the session. All rescheduling requests must be
submitted in writing. Requests made with less than 24 hours’ notice may result in the
session being forfeited and fees being charged. However, Real Knowledge Academy may, at
its sole discretion, allow rescheduling in exceptional circumstances, such as illness or
emergencies.
13) No refunds are available for any completed one-on-one tutoring sessions, group
sessions, online sessions, academic mentoring sessions or block sessions. Program
subscriptions, including Project 99.95 and Project 99.95 Elite, are invoiced and payable on a
monthly basis in advance and a parent/guardian or student may opt out of a program
subscription at any point in time without any further obligation. Any advance payment by
the parent/guardian or student for future monthly program fees will be refunded in full less
admin fee of $120.00, however no refunds are available for any program subscription fee
paid for the current subscription month at the time of requesting cancellation of a program
subscription.
14) RKA may reschedule a session, a number of sessions or program due to illness,
emergencies, operational requirements or for any other reason and in any such
circumstance will endeavour to provide reasonable notice to the student or parent/guardian
wherever possible. Alternative times and dates may be offered to reschedule a session or
program.
15) RKA collects and handles personal information in accordance with the Privacy Act 1988
(Cth) and Australian Privacy Principles. Please refer to our Privacy Policy for further details.
16) For any RKA services delivered online, sessions may be recorded for quality assurance,
safeguarding, or student access. For any RKA services delivered online or via recordings,
third-party software platforms and apps may be used and reasonable steps are taken to
ensure appropriate security, however cyber security cannot be guaranteed.
17) In accessing or utilising the RKA website and any associated websites a user must not
use the website unlawfully, attempt to interfere with website functionality or misuse the
booking or contact systems. RKA reserves the right to restrict website access where misuse
occurs.
18) In providing educational support services, RKA does not guarantee that a student will
obtain any specific grade, ATAR score, university admission outcome, attain a scholarship or
achieve any specific examination outcome or interview outcome. RKA makes no
representations, warranties, or guarantees regarding specific examination outcomes, ATAR
Scores, university entrance results, interview outcomes, assessment results, specific grades
on school report cards or scholarship applications. Academic performance, associated
results and outcomes depend on the effort, engagement, commitment and performance of
each individual student and external assessment processes beyond our control.
19) The Real Knowledge Academy is committed to providing a safe, supportive, and
respectful learning environment for all students. RKA operates in accordance with the Child
Protection Act 1999 (Qld), the Working with Children (Risk Management and Screening) Act
2000 (Qld), relevant Queensland child safety standards, and the Privacy Act 1988 (Cth).
20) RKA maintains appropriate records of Blue Card status of all tutors providing educational services and educational programs to its students. All tutors engaged by RKA are responsible for obtaining a current valid Queensland Blue Card or maintaining valid working with children checks or clearances for their respective Australian State or Territory.
21) RKA implements reasonable risk management practices, including maintaining
professional boundaries, conducting sessions in transparent settings where possible (physical or online), and using approved communication platforms. Online sessions may be recorded for
safeguarding and quality assurance purposes. A student’s parents/guardian may request
clarification regarding recording practices.
22) All tutors must maintain clear professional boundaries, avoid inappropriate relationships
or private communication outside approved channels, and ensure parental awareness when
engaging with students under 18 years of age.
23) RKA also provides educational tutoring and coaching services to support students
preparing for university course selection processes, including Multiple Mini Interviews and
related interview formats. All services are strictly skills-based and developmental in nature,
focusing on general competencies such as communication, ethical reasoning, critical
thinking, professionalism, and interview confidence. By enrolling, the student acknowledges
that these services are intended to enhance their ability to present themselves effectively
and to develop a strong, adaptable, and professional mindset when attending interviews.
24) RKA operates in good faith and in alignment with the standards, expectations, and
ethical frameworks underpinning Australian University Medical and Dental school and other
course admissions processes, including those associated with the UCAT ANZ Consortium and
individual university selection policies.
25) RKA expressly affirms that it does not engage in any conduct that compromises, or may
reasonably be perceived to compromise, the integrity, confidentiality, or fairness of the
university admission processes. RKA does not provide services that replicate, disclose, or
approximate confidential assessment content and RKA supports the principle that all
candidates seeking university admission should be assessed on their own abilities,
attributes, and preparedness, consistent with published admissions criteria.
26) To the extent permitted by law, RKA is not liable for indirect, incidental, or
consequential loss arising from the use of its services or website. Where services are
supplied, RKA’s liability for failure to comply with statutory guarantees under Australian
Consumer Law is limited, at RKA’s option, to re-supplying the services or paying the cost of
having the services supplied again. Nothing in these terms and conditions excludes rights
that cannot lawfully be excluded under Australian law.
27) The parent/guardian and student engaging RKA educational services or programs agree
to indemnify and hold harmless RKA, its directors, employees, and contractors from any
claims resulting from participation in its services or the use of any materials or information
provided.
28) The parent/guardian and student engaging RKA educational services or programs agree
to indemnify and hold harmless RKA, its directors, employees, and contractors from any
claims, liabilities, or losses arising from a breach of these terms and conditions.

29) To the fullest extent permitted by law, RKA shall not be liable for any loss or damage
including indirect or consequential loss arising from outcomes related to examination
results, assessment outcomes, ATAR scores, university application results or interview
outcomes.
30) RKA promotes a transparent and supportive educational environment and has clear
dispute resolution processes. If any parent/guardian or any student have any particular
concern, they are encouraged to immediately contact their tutor. If a concern is not
resolved by the tutor, a parent/guardian of a student may contact the RKA admin team to
have their concern addressed. In the event of any unresolved dispute, the parties agree to
first attempt resolution through good faith negotiation.
31) RKA reserves the right to update, change or modify the terms and conditions and service
formats from time to time.
32) All materials provided by RKA, including teaching resources, frameworks, recordings,
branding, and written content, remain the intellectual property of the Real Knowledge
Academy.
33) Materials may not be copied, reproduced, shared, distributed, uploaded, or resold
without prior written consent from RKA. Unauthorised use may result in termination of
services and legal action.
34) These terms and conditions are governed by the laws of Queensland, Australia. The
parties submit to the exclusive jurisdiction of the courts of Queensland. Nothing in these
terms and conditions excludes, restricts, or modifies any rights or remedies available under
applicable laws in other Australian states or territories, including but not limited to child
protection and working with children legislation. Tutors, students and parents/guardians of
students are responsible for complying with all applicable laws in the jurisdiction in which
services are provided or received.
35) Nothing in these Terms limits rights under the Competition and Consumer Act 2010
(Cth), including Australian Consumer Law.
36) By enrolling in RKA’s services or purchasing RKA educational programs, the student and
the student’s parent/guardian agree to be bound by these terms and conditions. Continued
use of RKA services or the RKA website or services constitutes acceptance of any revised
terms and conditions.
